Acceptance of Terms
Acceptance of any contribution, gift or grant is at the discretion of the Mopane Foundation. The Mopane Foundation will not accept any gift unless it can be used or expended consistently with the purpose and mission of the Mopane Foundation.
No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.
The Mopane Foundation will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.
The Mopane Foundation will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the Mopane Foundation.
Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for Mopane Foundation.
The Mopane Foundation will provide acknowledgments to donors meeting tax requirements for property received by the charity as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by Mopane Foundation.
The Mopane Foundation will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the Mopane Foundation will restrict information about the donor to only those staff members with a need to know.
The Mopane Foundation will not compensate, whether through commissions, finders' fees, or other means, any third party for directing a gift or a donor to the Mopane Foundation.
Data Protection and Privacy
Your data will be held securely and in accordance with the Data Protection Act 2018 (DPA), the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), the Regulation of Investigatory Powers Act 2000, the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000, the Electronic Communications Data Protection Directive 2002/58/EC, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and all applicable laws and regulations relating to Processing of Personal Data and privacy, including where applicable the guidance and codes of practice issued by the Information Commissioner.
NHS Jobs has an interface to the Electronic Staff Record System (ESR) which is a payroll and human resources system used by most NHS organisations and by a number of other organisations providing NHS services. The data you submit to NHS Jobs may be transferred to ESR for the purposes of: establishing the human resources and payroll record; completing the recruitment process or parts of the process on ESR; or for reporting purposes such as equal opportunity monitoring.
The data you submit to NHS Jobs as part of your job application may be downloaded and transferred to either the employer’s own system or a third party system where an employer chooses to complete the recruitment process using a different system.
If you apply for a job on NHS Jobs then the employer which advertised the job will have access to your application and any other material you submit in support of the application. Any attachments that accompany your application will be visible to the shortlisting panel. Please note the monitoring and safeguarding sections are not made visible to the shortlisting panel. The safeguarding section may be made visible to the interview panel but that is dependent on the individual recruiting organisation. Employers may copy and hold some or all of this data locally in their own systems to facilitate their administration of the recruitment exercise.
An employing organisation has an obligation to inform you how they are processing your application data including but not limited to:
- automatic decision making on selection,
- updating information the employing organisation has downloaded from NHS Jobs,
- withdrawing an application the employing organisation has downloaded from NHS Jobs
- how the employing organisation handles attachments that accompany the application form
- what the employing organisation uses the Equality and Diversity data for
- how the employing organisation handle any safeguarding concerns
